Revocation right for consumers

A consumer is any natural person who concludes a legal transaction which, to an overwhelming extent, cannot be attributed to either commercial or independent professional activities.

You have the right to revoke this contract within 21 days without specifying any reasons.

The revocation period is 21 days from the day:

• on which you or a third party nominated by you, who is not the carrier, took possession of the products, provided you ordered one or more products within a standard order and these products are delivered together;
• on which you or a third party nominated by you, who is not the carrier, took possession of the last product, provided you ordered several products within a standard order and these products are delivered separately.

To exercise your right of revocation, you must inform us (Deeluxe Sportartikel Handels GmbH, Europastrasse 8/1, 6322 Kirchbichl, Austria, Tel.: +43 (0) 5332 930 81, E-Mail: info@deeluxe.com) by means of a clear declaration (e.g. a letter sent by post or an e-mail) of your decision to revoke this contract.

You may use the model revocation form below, but this is not mandatory.

To meet the revocation deadline, it is sufficient that you send your notification before the revocation period expires.

Consequences of the revocation

If you revoke this contract, we shall reimburse all payments received from you, including delivery costs, except for additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us.

Reimbursement will be made without undue delay and no later than 14 days from the day on which we receive notice of your revocation. We will use the same means of payment as used for the original transaction unless expressly agreed otherwise.

We may withhold reimbursement until we have received the products back or you have provided evidence that you have returned the products, whichever is earlier.

You must return the products to us without delay and in any event no later than 14 days from the day on which you notify us of the revocation. The deadline is met if you send the products before the 14-day period has expired.

You bear the direct costs of returning the products.

You are only liable for any diminished value of the products resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the products.

Criteria for exclusion or expiry

The revocation right does not apply to contracts for:

• delivery of products that are not prefabricated and are made to the consumer’s individual specifications or clearly tailored to personal requirements;
• delivery of products that can deteriorate quickly or have a short expiry date;
• delivery of alcoholic beverages whose price was agreed at the time of concluding the contract, which can be delivered no earlier than 30 days after conclusion of the contract and whose value depends on market fluctuations beyond the trader’s control;
• delivery of newspapers, periodicals or magazines, with the exception of subscription contracts.

The revocation right expires prematurely for contracts:

• for delivery of sealed products which are not suitable for return for health protection or hygiene reasons if the seal has been removed after delivery;
• for delivery of products which have been inseparably mixed with other goods after delivery due to their nature;
• for delivery of sound or video recordings or computer software in a sealed package if the seal has been removed after delivery.
